Terms of Service

Version 2026-09-11.1

1. Definitions and Registration

"Platform" the AI gateway service that unifies access to various third-party AI models behind one compatible endpoint.

"User" any individual or entity that registers for or uses the Service.

"Token/credit" the internal balance unit used to pay for API requests.

"API Key" a secret credential used to authenticate requests.

Registration requires your name and a valid email address; email verification may be required for particular features. Passwords are stored only as salted password hashes and never in plain text. Each individual or entity may maintain one account; creating multiple accounts to evade limits is prohibited. You are responsible for securing your credentials and for activity performed through your account. You must be at least 17 years old to register an account.

2. Nature of the Service

  1. Access to various AI models through one API key, using Pay As You Go balance and/or Token packages.
  2. Pay As You Go applies to models permitted for your API key. Token packages apply only to the package's permitted models, which are shown before purchase.
  3. Model availability may change at any time because of maintenance, demand surges, disruptions, or technical conditions.
  4. The Platform does not guarantee that any specific model will always be available without interruption.
  5. Check model status before purchasing. If a model is disrupted, you may retry the request or use an alternative model.

3. Tokens and Consumption

  1. Token consumption varies by model and workload. It is affected by context length, conversation history, output, files, reasoning, tool calls, coding agents, and retries by third-party applications.
  2. Published prices, credit rates, and consumption rules may change. A change applies only to future requests accepted after it takes effect; a request already admitted with a recorded pricing snapshot remains governed by that snapshot. Existing balance quantities are not reduced by a later price publication.
  3. The purchase price of tokens is not a measure of the cost of a single request.
  4. Coding agents and long conversations can consume substantially more tokens.
  5. Requests that fail before producing output are not charged. If partial output was delivered, the processed portion may be counted.
  6. A Token purchase adds a perpetual package or quota to your account. API keys use that quota only when the mode and model are permitted. Packages remain valid until their quota is exhausted.
  7. Token packages such as Spark, Blaze, Inferno, and Ember remain valid until their quota runs out; remaining quota never expires. Pay As You Go balances and Token quota also never expire because of inactivity.
  8. Token stock may be opened or closed at any time to preserve service stability.
  9. Pay As You Go balances, Token quota, bonuses, and promotional credits cannot be cancelled, transferred between accounts, or redeemed for cash. Every completed purchase is final, except where mandatory law requires otherwise or we confirm a duplicate or incorrect charge.

4. Security and Acceptable Use

  1. You are responsible for safeguarding your API keys and must not share them.
  2. Third-party applications may use your key. Parallel retries and large contexts generated by those applications affect your usage.
  3. Prohibited conduct includes illegal activity, fraud, spam, malware, cyberattacks, system exploitation, and any attempt to bypass billing.

5. Support and Moderation

  1. When reporting a problem, contact support with the incident time, model, error message, and a screenshot.
  2. Criticism, suggestions, and reports are welcome when they are constructive, clear, relevant, and made in good faith, without insults, threats, defamation, spam, intimidation, or personal attacks.
  3. Moderation may be gradual or immediate and can include warnings, message deletion, muting, communication limits, refusal of abusive support requests, group removal, or blocking community access.
  4. Serious, repeated, or security-related violations may result in suspension of accounts and API keys without prior notice when immediate protection is required.
  5. Community moderation sanctions do not automatically erase transaction history or arbitrarily seize balances. Usage may still be restricted for violations, security risks, abuse, billing evasion, or legal obligations.

6. Legal Status and Policy

  1. Mortera Cloud is an independent gateway. Unless a relationship is expressly confirmed in writing, it is not an official service, affiliate, representative, reseller, or partner of any AI model provider or model developer whose models, names, or interfaces may be available through the Service, including OpenAI, Anthropic, Google, Meta, or others.
  2. There is no obligation to purchase or use the Service.
  3. Users who prioritize an official relationship or direct provider support should subscribe directly through the official provider.
  4. By purchasing or using the Service, you acknowledge the risks of a third-party service, including catalog changes, token consumption, market pricing, disruptions, provider restrictions, and policy changes.
  5. Products are managed according to internal policy, rules of conduct, operational standards, and internal decisions.
  6. Final decisions concerning products, pricing, token consumption, the catalog, features, operations, and moderation rest with the service operator.

7. Payments, Balances, and Referral Rewards

  1. Top-ups may be processed through available methods such as QRIS, virtual accounts, e-wallets, USDC, or manual approval. Third-party payment processors and network providers process the applicable payment details.
  2. All completed purchases and credited balances are final: no cancellation, transfer between accounts, or cash redemption is permitted, except where mandatory law requires otherwise or we confirm a duplicate or incorrect charge.
  3. Unused Pay As You Go balances and Token quota remain valid indefinitely and do not expire solely because an account is dormant or inactive.
  4. Bonus and promotional balances cannot be redeemed for cash.
  5. Referral rewards follow separate rules. A qualifying purchase can earn a reward for the account whose referral link was used. A reward becomes spendable credit balance only after the holding period of the related purchase ends.
  6. If the related purchase is cancelled within that holding period, the matching reward is reversed, and spendable balance that already came from that reward may be reduced accordingly.

8. Amendments to These Terms

  1. We may amend or update these terms over time, for example when products, security measures, provider conditions, or applicable law change. The current version is always published on this page together with its version date.
  2. Every material change to these terms - including pricing, features, usage limits, or Service availability - will be announced via your registered email, a dashboard announcement, or both, at least 1 day before it takes effect. You will have that window to use your Pay As You Go balance and Token credits.
  3. Continuing to use the Service after the stated effective time counts as accepting the updated terms. Purchases made and requests accepted before that time remain governed by the previous version, including the pricing snapshot recorded on each admitted request.
  4. When a material change would substantially reduce what your unused, unexpired balance can pay for, the announcement window gives you reasonable time to use your balance under the previous rules. Only events outside our reasonable control (a legal or regulatory order, a security incident, or a binding condition imposed by a third-party provider) can shorten this notice, and any such shortening still applies only to future activity.

9. Limitation of Liability

  1. The Service is provided "as is" without warranties of availability, accuracy, or fitness for a particular purpose.
  2. The Platform is not responsible for downtime, quality degradation, or behavioral changes in models operated by third-party providers.
  3. You are responsible for backing up your own data, logs, and outputs. The Platform does not guarantee retention beyond its operational policy.
  4. The Platform is not liable for indirect or consequential damages or loss of profit.
  5. Maximum liability for a claim is limited to the total value of your transactions during the applicable period, such as the preceding three months.

10. Copyright and Intellectual Property

  1. Trademarks, logos, and user interface elements belong to the Platform and are protected by law.
  2. AI models accessed through the Service belong to their respective providers. You must comply with each provider's terms of use.
  3. Model output belongs to you, subject to provider terms. The Platform claims no ownership of that output.
  4. You may not remove or alter watermarks, attribution, or copyright notices.

11. Account Termination

  1. The Platform may suspend, restrict, or delete accounts that violate these terms, commit fraud, or endanger the system.
  2. You may ask support to close or anonymize your account, subject to identity verification and records we must retain for billing, fraud prevention, disputes, tax, accounting, or other legal obligations.
  3. Closing, suspending, restricting, or terminating an account does not create a right to cancel a purchase, transfer, or redeem any remaining balance for cash, except where mandatory law requires otherwise or we confirm a duplicate or incorrect charge.
  4. Promotional and bonus balances are never transferable or redeemable for cash. Access to any remaining balance may be lost when an account is terminated for a violation, subject to mandatory law.

12. Governing Law

  1. These terms are governed by and construed under the applicable law.
  2. Disputes will first be resolved through deliberation. If no resolution is reached, disputes will proceed through the applicable legal mechanisms.
